Illegal To Drive Rental Car Under 21?

If someone over the age of 25 rents a car, would it be considered illegal for someone (20 years old) who wasn't listed on the rental agreement to drive it, even if that person had a vaild US drivers license and insurance?Illegal To Drive Rental Car Under 21?

Yes, it would be considered to be a violation of the terms and conditions of the rental agreement that the renter signed. Rental car companies require that additional drivers must be 25 or over and must be present at the rental counter to complete and sign an additional driver form.





If the rental car was damaged in any way (by the renter or unauthorized driver) the renter of the vehicle would be fully responsible for any damages to the car... any insurance coverage that they had or had purchased would be considered null and void, because they had violated the terms and conditions on their rental agreement.
It would definitely be a civil violation, and possibly fraud.


If there was an accident, both the underage driver and the renter would be sued and, depending on the severity of the accident, the District Attorney could file charges.


Rottondog93 is wrong. There would not be charges for a stolen car, because the rental company ';entrusted'; the car to the renter, and then the renter ';entrusted'; the car to the second driver. The charges I think likely would involve negligence, reckless endangerment, etc.
It's not illegal as in go to jail illegal but it is a breach of the contract the person signed. It could lead to them being sued by the rental company should something happen to the car.
Should you have an accident while driving the car, the rental company by all rights can have you charged with stealing the car.
Yes...........it would be completely illegal and you would not be covered if you had an accident.
