I had an accident 3/18/08. I'm still waiting to be paid and I need a rental car, do they have to provide one?

The accident was the other motorist fault. His insurance has taken responsibility. They have made me an offer however we are still waiting for payment to be issued due to paperwork needed, i.e. Title or a letter from the lien holder. The insurance companies obligation to provide a rental -ends when they make a reasonable offer. They do not owe you a rental until you get a check. Therefore, if they need paperwork from you - get it back to them as quickly as possible.

You need to phone your insurer to ask them if your policy comes with legal expenses included. Most major insurers now include it as standard. Usually a small percentage of your premium is used to cover the cost of legal expenses.





Your insurer will not provide a courtesy car if the claim is not your fault, as you are claiming off the other driver's insurance. However, if they have included legal expenses in your insurance premium, they will give you the name and telephone number for the agency who handles this for them, or if you have your policy booklet, you can get it from there.





If you phone the agency who your legal expenses cover is with, they will ask you some basic questions to find out who was to blame for the accident, then at no cost to you, they will put you in a courtesy car until your car is repaired, and usually appoint a solicitor free of charge if you want one. The solicitor will get you compensation for any injuries to you or any passengers, and he will also sue the other insurer for any expenses you have incurred, that you would not have incurred if you hadn't had the accident, so it is worth keeping receipts. If you have had to pay an excess for the repair to your car, the solicitor will also get that back for you. It is well worth doing. Why should you be inconvenienced for someone else's fault? It is extremely rare that you have to go to court or even see the solicitor as most of it is done between the solicitor and the other insurer. It does take time for the solicitor to pursue the claim. Usually 4-6 weeks, but it is worth it when you get the cheque.
For the time between the date of the accident, and the offer being made, if you had no other means of transportation you *might* have been entitled to a rental. But per your question, they have settled. So no, at this point you are not. I'd suggest to get whatever they need to send you the check so you can move on.

I think what your suppose to do is pay for it yourself until this is all settled in court, but save all of your receipts and also call your insureance people and ask them they may just be the ones who will provide you with your ';Rental'; and pay for it until this is settled through each of your insurances. I'm not sure which or who? But, I would definitely call your Insurance People and ask them before you go down and rent your vehicle until your car gets replaced, or fixed. This way your not doing things the wrong way and getting messed-up with the payments when it could have been FREE, no what I mean.? Good Luck. Smile!! It'll all work out!:)
yes they are legally responsible for providing a rental for you however it is a insurance company their not going to automatic offer this to you you call them and tell them not ask but tell them that you need a rental car you do not have transportatation because of this accident %26amp;i bet you money they'll send that payment so fast it willl make your little head swim because they do not want to pay anymore money than they have to do it %26amp;have a good laugh at how stingy they are lol!!
Is your vehicle drivable (safe)? Is it going in for repairs? You need to go by the estimate written. How many days is it going to take to repair? Is it a total loss? You should have been able to get into a comparable vehicle from the time your vehicle was disabled until (normally) 3 days after they made you an offer.
yes you are entitled to a rental car. The insurance should make arrangements and take care of all the payments. If they say they want you to pay and they will reimburse you later, tell them no, you want them to make payment directly to the rental company.
No you are not.





Legally, they only owe until an offer has been made to you. It is not the insurance companies fault that you need to obtain paperwork in order for them to send the check.
