My wife went through an electronic toll lane by mistake while driving a Dollar Rental car. The toll authority mailed Dollar Rental the citation. Dollar didn't bother to give me a copy. Just a few days before the 30 day window for paying the citation lapsed, Dollar sent the toll authority a form transferring liability to me. For that Dollar charged me a $25 administrative fee, claiming that I didn't pay the citation in time. There was actually no way for me to pay it because the citation was not issued to my wife on the spot. Dollar did not sent a copy of the ticket until after it charged the $25 fee. If I file a chargeback with my credit card company, what is the likelihood that Dollar will try to get the $25 through its collections dept or a collections agency? I would recommend posing your question outside of this arena. The key to your question is: the charge is for a ticket associated with a governmental agency. You definitely will want to review the rights determined based on your Rental Agreement. At the same time, I would recommend that you contact the City, County or State in which the Citation was issued. Do you/wife have the right to dispute the Citation with them? Disputing a charge on a credit card does not guarantee a refund. It is a right provided to you via the particular card issuer's affiliation with Visa or Mastercard. Visa or Mastercard arbitrate the case between the card issuer and the merchant's bank. If you would have a high likelihood of convincing a judge in small claims court that you have a legal right to not be issued a citation, you have the same likelihood of successfully charging back the fee.Will Dollar Rental Car take a $25 chargeback to collections?
$25.00 dollars isn't worth your good credit. With that on your record could cost you a whole lot more. Fighting for principle is one thing; but do you want to take the time out of your life to deal with their dumb polices?
I would dispute the chargeback after you have called and spoken to a manager at the dollar rental. Citing that you were not given a copy of the ticket until after the due date and you should have not been charged the 25 dollar fee because of an error on thier part. If you have the original envelope with the post date of when the copy of the ticket finally arrived that would be great to have so you can copy it and show it to them. If they still don't see it that way I would call your credit company and dispute the charge. I'm doubtful they would send a collection company after you for 25 dollars when it would cost them more than that just to have the collection company get it.
First, send X-Man your bill, so he can pay it. He's obviously a stand-up guy who'll do it for you.
Me? I don't bend to blackmailers. Read your lease agreement and see if they had any right to these fees. Dispute the charge, and let them take you to court!
If they even try to put it on your credit report, follow the procedure in the Fair Credit Reporting Act to get it removed. If they still don't, sue them for placing unvalidated reports on your credit history.
