No penalty if you have a valid license and if you are driving with the permission of the person who rented the car. The police have nothing to do with enforcing the terms of the rental agreement. The renter is violating the contract but that is a civil matter, not criminal. If you have an accident you better have your own insurance because the rental insurance will refuse to pay and you may find out that your insurance won't cover you in a rental either if it's in violation of the rental contract.
Well, they won't RENT it to you, if you're under 21. If someone over 21 rents it, and they find out you were driving, they'll go back and surcharge their credit card monster fees - like $250 a day.
