Maybe if you could prove that the car had been in an accident before where the airbag deployed and that it was not replaced. Don't think so.

I am going to do the annoying thing and answer your question with another few questions:





1. Why the rental company and not the manufacturer of the vehicle?


2. Did the rental company make an on paper claim that the car was in good repair? (probably, the real question-do you have a copy of it? )


3. Is checking the air bags part of regular maintenance? If so and if the rental company can prove that they had maintained the vehicle then you would have to find the company that fouled up the maintenance... wouldn't you?





I am very sorry to hear that you were hurt and do think that you should be compensated. You have a reasonable expectation that when you rent a vehicle that is presented as being in working order that the vehicle is, in fact, in working order in every necessary aspect. I just don't know who you need to talk to first, perhaps many people.





My best advice is to get a lawyer, the last thing you want is to have your case dismissed simply because you are inadvertently placing blame on the wrong party/parties.
You'd have to prove that the air bags deploying would be their negligence.





Likely the person at fault in the accident would be paying for it anyways, if he didn't get insurance for yourself in that respect, it would be your fault.





It would be likely that the manufacturer of the car would be responsible for the air bags, not the rental company, unless the airbags were part of a recall.

I presume you had insurance? There you go. You will probably have a tough time getting anything out of the rental car company since your medical expenses %26amp; lost work should be covered by the insurance.





If you're really set on trying to squeeze money out of the rental car company you need to talk to a lawyer who specializes in such cases. i'm sorry you have no been so fortunate, but look at it this way, when you get through this, you will hopefully have more empathy for others than any of these oafs.





you need to talk to a lawyer and find out how best to recover your losses and estimate of any future losses.





don't take this lightly. you were injured and you don't really know how long your recovery may be or, what other ramifications may surface. protect yourself by putting your case in capable hands. you are not qualified to handle this on your own behalf.
It is likely not the fault of the rental car company for the airbags not deploying. Any number of factors could have caused the airbags to not deploy, vehicle maintenance is probably not one of them.

You can sue them for all you want, but they won't pay you anything. It isn't their fault the airbags didn't deploy. Sue the car maker instead but then again they don't have any money either. Better win the lottery then!
You had an accident, you didn't win the lottery. You can probably get them to cover medical bills and maybe your expenses while you're out of work.
