If you were choosing to use your own personal insurance to cover the rental car, or coverage from your credit card, you should have checked the terms and conditions of these coverages. They will specifically state, if they cover the loss of use, which is charged by the rental company for the daily cost of the rental car not being able to be rented. This charge is over and above what the cost of the damage to the rental car is. I'm sorry, yes they can charge loss of use. Yes, they can and they will if you signed the insurance waiver and there is no way your insurance company is going to pay the loss of use.
They are a rental agency, they make money when they rent the car, they can't make the money since you wrecked it.
But... rental agencies can get down right dirty, they will charge loss of use for every day the car is out of commision even though the car would not be rented out 100% of the time, it could be on the lot 40% of the time waiting to be rented. That is not fair and possible something to fight.
They can charge you for the cost of the vehicle if:
1) You didn't purchase insurance through them.
2) If your insurance company doesn't cover with the coverages you have.

The costs are going to be much more than you're prepared to pay.
